Terms of Service

1. Acceptance

By using PestRecord (the "Platform"), you agree to these Terms of Service. If you do not agree, do not use the Platform. These terms are governed by the laws of Ontario, Canada.

2. Platform Description

PestRecord is a lead marketplace. We connect homeowners ("Homeowners") who have pest control needs with licensed pest control professionals ("Professionals"). We are not a pest control company. We do not perform pest control services, employ Professionals, or guarantee service outcomes.

3. Homeowner Terms

  • You must provide accurate information about your pest problem and property.
  • By submitting a lead, you consent to being contacted by up to 3 licensed pest control professionals.
  • You are not obligated to hire any Professional who contacts you.
  • PestRecord is not a party to any agreement between you and a Professional.
  • You must be 18 years of age or older to use this Platform.

4. Professional Terms

  • You must hold a valid Ontario Exterminator License or Structural Extermination License, as applicable.
  • You must maintain valid liability insurance of at least $2,000,000 CAD.
  • Credits are non-refundable once a lead has been unlocked, except where the lead contact information is demonstrably invalid.
  • You may not share, resell, or transfer lead contact information to third parties.
  • PestRecord may suspend or terminate your account for misrepresentation, policy violations, or sustained low customer ratings.

5. Credits and Payments

Credits are purchased in advance and deducted when you unlock a lead. Credits do not expire. All purchases are processed in Canadian dollars (CAD) via Stripe. By purchasing credits, you agree to Stripe's Terms of Service.

6. Prohibited Conduct

  • Submitting false or misleading leads or applications
  • Attempting to bypass the credit system or access leads without payment
  • Harassment of any user of the Platform
  • Reverse engineering or scraping the Platform
  • Using the Platform in violation of any applicable law

7. Limitation of Liability

PestRecord is a marketplace facilitator. To the maximum extent permitted by Ontario law, our liability for any claim arising from use of the Platform is limited to the amount you paid to PestRecord in the 90 days preceding the claim. We are not liable for the acts or omissions of any Professional or Homeowner.

8. Dispute Resolution

Any dispute arising from these Terms will first be submitted to good-faith negotiation. If unresolved within 30 days, disputes will be submitted to binding arbitration in Toronto, Ontario, in accordance with the Ontario Arbitration Act, 1991.

9. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by email to registered users. Continued use of the Platform constitutes acceptance.
